Who We Are and What This Policy Covers
Luscent Red ("Luscent Red", "we", "us", or "our") sells light-therapy devices, including an infrared sauna blanket and an LED and laser face mask. We are based in Australia and we sell and ship only to customers in the United States and Australia.
This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you visit our website, place an order, contact us, or otherwise interact with us. It applies to all personal information we handle as the controller of that information. This policy should be read alongside our Terms of Service, Refund Policy, and Shipping Policy.
For the purposes of applicable privacy laws, Luscent Red is the controller (and, under Australian law, the entity responsible) for your personal information. Where this policy refers to "personal information", it includes "personal data" and "personal information" as those terms are defined under the Australian Privacy Act 1988 (Cth) and applicable United States state privacy laws.
This policy does not apply to third-party websites, products, or services that we do not own or control, even where we link to them. When you follow a link to a third-party site, that site's own privacy policy governs your information.
By using our website or providing your personal information to us, you acknowledge the practices described in this policy.
Information We Collect
We collect the following categories of personal information.
Contact and order information. When you place an order, create an account, or contact us, we collect information such as your name, email address, phone number, billing address, shipping address, and the details of the products you order. We use this information to process and fulfil your orders and to communicate with you about them.
Payment information. When you make a purchase, payment card and related billing details are collected and processed by our payment processors. We do not store full payment card numbers on our own systems. Our payment processors handle that information under their own security standards and privacy terms.
Communications. When you email us, complete our contact form, respond to a survey, leave a review, or otherwise communicate with us, we collect the content of those communications and any contact details you provide, so that we can respond and keep records of our correspondence.
Account information. If you create an account, we collect your login credentials and any preferences or saved details you choose to store with us.
Device and usage information. When you visit our website, we and our service providers automatically collect certain information about your device and how you use our site. This may include your IP address, device and browser type, operating system, referring and exit pages, pages viewed, links clicked, the dates and times of your visits, and approximate location derived from your IP address. We collect this information using cookies, pixels, and similar tracking technologies, as described in "Cookies and Tracking Technologies" below.
Marketing information. If you subscribe to our emails or SMS messages, or enter a promotion, we collect your contact details and your communication preferences.
We collect this information directly from you, automatically through your use of our website, and from our service providers and advertising and analytics partners.
How We Use Your Information
We use your personal information to:
- Process, fulfil, and deliver your orders, including arranging shipping and handling returns and refunds.
- Take payment and detect and prevent fraud and other unauthorised or unlawful activity.
- Create and manage your account.
- Respond to your enquiries, requests, reviews, and support questions.
- Send you transactional messages, such as order confirmations, shipping updates, and service notices.
- Send you marketing communications where you have asked to receive them or where we are otherwise permitted to do so, and let you opt out at any time.
- Operate, maintain, secure, personalise, and improve our website and our products and services.
- Measure and understand the effectiveness of our website, content, and advertising, and to serve and measure advertising on other platforms.
- Comply with our legal obligations, enforce our terms, and protect our rights, our customers, and the public.
Where Australian law requires it, we will only use or disclose your personal information for the purpose we collected it, for a directly related purpose you would reasonably expect, or where you have consented or the law otherwise permits.
Cookies and Tracking Technologies
We and our partners use cookies, pixels, tags, web beacons, software development kits, and similar technologies to operate our website, remember your preferences, analyse traffic and usage, and deliver and measure advertising.
Cookies are small files placed on your device. Some are essential to make the site work (for example, keeping items in your cart). Others help us understand how the site is used or allow us and our advertising partners to show you relevant ads and measure their performance.
The main providers whose technologies we use include:
- Shopify, which powers our online store and sets cookies needed to run the website, manage your cart and checkout, and keep the site secure.
- Google (including Google Analytics and Google Ads), which helps us measure website traffic and the performance of our advertising, and supports advertising on Google's platforms.
- Meta (including Facebook and Instagram), through the Meta Pixel and related tools, which helps us measure and deliver advertising on Facebook and Instagram.
- Microsoft Clarity, which helps us understand how visitors use our website through analytics such as aggregated session and interaction data.
You can control cookies through your browser settings, including by blocking or deleting them, although disabling some cookies may affect how the website works. Where required, we will ask for your consent to non-essential cookies and give you the ability to manage your choices. You can also opt out of certain advertising as described in "Your Privacy Rights" below.
How We Disclose Your Information
We do not sell your personal information for money. We share personal information only as described in this policy, including with the following categories of recipients.
E-commerce and hosting. We use Shopify to host our online store and process orders. Shopify handles personal information on our behalf to operate the website, manage your cart and checkout, and store order records.
Payment processors. We share payment and billing information with payment processors to take payment, verify transactions, and prevent fraud.
Shipping and fulfilment partners. We share your name, shipping address, and order details with carriers and fulfilment partners so they can deliver your order and handle returns.
Marketing, analytics, and advertising partners. We share certain information, including device and usage information and online identifiers, with analytics and advertising partners such as Google, Meta (Facebook and Instagram), and Microsoft Clarity, so that we can measure and improve our website and advertising and show you relevant ads. Some of this sharing may be considered a "sale" or "sharing" of personal information, or processing for "targeted advertising", under United States state privacy laws. See "Your Privacy Rights" below for how to opt out.
Service providers. We share information with vendors who perform services for us, such as customer support tools, email and SMS providers, IT and security providers, and review platforms, who may only use it to provide services to us.
Legal and protective disclosures. We may disclose personal information where we believe it is reasonably necessary to comply with the law, a legal process, or a lawful request, or to enforce our terms, protect our rights or property, or protect the safety of any person.
Business transfers. If we are involved in a merger, acquisition, financing, reorganisation, or sale of assets, your personal information may be transferred as part of that transaction, subject to this policy or a successor policy.
International Transfers
Luscent Red is based in Australia and sells and ships to customers in the United States and Australia. Because we operate across these countries and use service providers located in the United States, Australia, and elsewhere, your personal information may be transferred to, stored in, and processed in a country other than the one you live in, including the United States.
Privacy laws in those countries may differ from the laws where you live. Where we transfer personal information across borders, we take reasonable steps to ensure it is handled consistently with this policy and with applicable law, including, where Australian law applies, the requirements of the Australian Privacy Principles relating to cross-border disclosure.
Your Privacy Rights
The rights available to you depend on where you live.
Australia
If you are in Australia, we handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). You have the right to:
- Request access to the personal information we hold about you.
- Request correction of personal information that is inaccurate, out of date, incomplete, irrelevant, or misleading.
- Ask how we collect, hold, use, and disclose your personal information.
- Opt out of receiving marketing communications from us at any time.
We will respond to your request within a reasonable period. If we refuse access or correction, we will tell you why, except where the law provides otherwise. To make a request, contact us at info@luscentred.com.
If you are not satisfied with how we have handled your personal information or your request, you can lodge a complaint with us first at info@luscentred.com so we can try to resolve it. If you are still not satisfied, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
United States
If you are a resident of a United States state with a comprehensive privacy law (such as California under the CCPA as amended by the CPRA, and similar laws in other states), you may have the following rights, subject to the limits and exceptions in your state's law:
- Right to know and access. You can request the categories and specific pieces of personal information we have collected about you, the sources, the purposes for collecting it, and the categories of third parties with whom we share it.
- Right to correct. You can request that we correct inaccurate personal information we hold about you.
- Right to delete. You can request that we delete personal information we have collected from you, subject to legal exceptions.
- Right to opt out of "sale" or "sharing" and targeted advertising. You can opt out of any "sale" or "sharing" of your personal information and of the processing of your personal information for targeted advertising.
- Right to non-discrimination. We will not discriminate against you for exercising any of these rights.
Notice about "sale" and "sharing". As described in "How We Disclose Your Information" and "Cookies and Tracking Technologies" above, we share certain information (such as online identifiers and device and usage information) with advertising and analytics partners, including Google and Meta (Facebook and Instagram), to deliver and measure advertising. Under some United States state laws, this kind of sharing may be treated as a "sale" or "sharing" of personal information, or as processing for targeted advertising, even though we do not exchange your information for money.
To opt out, you can:
- Email us at info@luscentred.com with the subject "Opt out of sale/sharing".
- Adjust your cookie and advertising preferences in your browser, and use platform-level controls, including a recognised opt-out preference signal such as Global Privacy Control where your browser supports it.
You may use an authorised agent to submit a request on your behalf where the law allows. We will take reasonable steps to verify your identity before acting on a request, and we will not charge you for exercising your rights except where the law permits.
To exercise any of these rights, contact us at info@luscentred.com or through the form at luscentred.com/pages/contact.
Data Retention
We keep your personal information for as long as we need it for the purposes described in this policy. This generally means for as long as you have an account or an active relationship with us, and for a further period afterwards to meet our legal, tax, accounting, and recordkeeping obligations, to resolve disputes, to prevent fraud and abuse, and to enforce our terms.
When we no longer need your personal information, we will take reasonable steps to delete it or de-identify it.
Security
We take reasonable steps to protect your personal information from misuse, interference, and loss, and from unauthorised access, modification, or disclosure. These steps include using reputable service providers such as Shopify and established payment processors, restricting access to personal information, and using technical and organisational safeguards appropriate to the information.
No method of transmission over the internet or method of electronic storage is completely secure, so while we work to protect your personal information, we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
Marketing Communications
If you have opted in to receive marketing emails or SMS messages from us, you can opt out at any time by using the unsubscribe link in any marketing email, replying STOP to a marketing SMS where that option is offered, or emailing us at info@luscentred.com. Even if you opt out of marketing, we will still send you transactional and service messages relating to your orders and account.
Children's Privacy
Our website and products are intended for adults. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us at info@luscentred.com and we will take reasonable steps to delete it.
Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will change the "Last updated" date at the top of this page, and where the changes are significant we will take reasonable steps to notify you. We encourage you to review this policy periodically. Your continued use of our website after an update takes effect means you acknowledge the revised policy.
